These terms and conditions apply to all transactions carried out on the Site, to the exclusion of all other general terms and conditions of sale or purchase. When registering personal data in the “my account” section, customers must ensure that the data they provide is accurate and complete, as it is essential for processing their order.<\/p>\n

In the event of an error, particularly in the recipient’s contact details, FRAN\u00c7OISE PARIS cannot be held responsible for the inability to deliver the product ordered.<\/p>\n

For security purposes, FRAN\u00c7OISE PARIS reserves the right to cancel any order when the IP address of the computer used by the Customer originates from a country other than the billing and\/or delivery address.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab gutter_size=”2″ column_padding=”2″ title=”II – PRODUCTS” tab_id=”1652263382-2-82″][vc_column_text uncode_shortcode_id=”504563″]In accordance with Articles L. 111-1 and L. 112-1 and L. 111-3 of the French Consumer Code, the essential characteristics and prices of the products offered for sale online on the Site by fran\u00e7oise-paris.com, as well as any delivery times for the products and the warranty conditions, are available on the Site.<\/p>\n

FRAN\u00c7OISE PARIS takes the utmost care in presenting and describing its products in order to provide the Customer with the best possible information. It is however possible that non-substantial errors may appear on the Site, which the customer acknowledges and accepts. The information provided is purely indicative.<\/p>\n

Similarly, the photographs on the Site are not contractual. They are intended to reflect the colors and shapes of the products as closely as possible. However, despite all the care taken by FRAN\u00c7OISE PARIS with the photographs, slight differences may exist, given that the settings on the Customer’s computer screen may influence the perception of the products. These differences are not likely to engage the responsibility of Fran\u00e7oise, the photographs having no contractual value.<\/p>\n

In any event, if the product delivered does not comply with its description on the Website, the Customer may either exercise their right of withdrawal (Article VI of the GTC) or invoke FRAN\u00c7OISE PARIS’s compliance guarantee (Article VIII of the GTC), which will then, where applicable and at its discretion, either exchange the product or refund the price (in whole or in part) that may have been charged.<\/p>\n

The Customer receives the information provided for in Articles L. 121-17 and L. 121-19-2111-1, L. 111-2 and L. 221-5 of the Consumer Code, before and after the conclusion of the sale, in a legible and understandable manner both on the Site and, in particular, by means of these GTC.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab gutter_size=”2″ column_padding=”2″ title=”III – THE ORDER” tab_id=”1652264587748-2-9″][vc_column_text uncode_shortcode_id=”746624″]Placing an order on the Website is subject to compliance with the procedure established by FRAN\u00c7OISE PARIS, which consists of a series of steps that the Customer must follow in order to confirm their order.<\/p>\n

It is understood that any order implies the payment of the price of the products selected by the Customer.<\/p>\n

The sale is deemed to have been concluded on the date of acceptance of the order by FRAN\u00c7OISE PARIS. Prior to this date, and in accordance with the provisions of article L. 221-25 of the French Consumer Code, the present conditions of sale are made available to all purchasers for information purposes.<\/p>\n

The Customer will have the opportunity, before definitively confirming his order, to check the details of the order and its total price, and to correct any errors, before confirming it to express his acceptance.<\/p>\n

Any order confirmed by the Customer is worth a sales contract and acceptance of all the stipulations of the present document.<\/p>\n

In accordance with Article L. 122-1 11 of the French Consumer Code, FRAN\u00c7OISE PARIS may refuse any order from a Customer for legitimate reasons, in particular if it is abnormal, placed in bad faith, or for any other reason, in particular if there is a dispute with the Customer or an incident relating to the payment of a previous order or which contravenes the provisions of these Terms and Conditions. In this case, FRAN\u00c7OISE PARIS will inform the Customer by email. If the Customer fails to correct the elements that are erroneous or contrary to these GTC, FRAN\u00c7OISE PARIS reserves the right not to process the order. <\/p>\n

A confirmation email summarizing the order (products, prices, product availability, quantity, etc.) will be sent to the Customer by FRAN\u00c7OISE PARIS to the email address provided by the Customer when placing the order, without delay once the order has been confirmed by the Customer. This e-mail contains a link to the withdrawal form in Appendix 1.<\/p>\n

To this end, the Customer formally accepts the use of electronic mail for the confirmation of the content of his order. In any case, the invoices are given at the time of delivery, on paper or in electronic format (PDF).<\/p>\n

FRAN\u00c7OISE PARIS undertakes to fulfill the order within the limits of available stock. If the product is unavailable, FRAN\u00c7OISE PARIS undertakes to inform the Customer as soon as possible.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab gutter_size=”2″ column_padding=”2″ title=”IV – PRICES AND PAYMENT TERMS” tab_id=”1652264688694-3-2″][vc_column_text uncode_shortcode_id=”894020″]1. The price of the products sold on the Site is indicated by article and reference respectively.<\/p>\n

The prices of the products are indicated in euros, all taxes included, except participation in the expenses of port. The total price of the order (taxes not included \/ shipping costs included) is indicated in step N\u00b05 of the payment.<\/p>\n

FRAN\u00c7OISE PARIS reserves the right to modify its prices at any time. The products will be invoiced on the basis of the prices in force at the time of the recording of the order, subject to availability.<\/p>\n

Any telecommunication costs inherent in accessing the Site shall be borne exclusively by the Customer.<\/p>\n

The validity period of offers and prices is determined by updates to the Website. FRAN\u00c7OISE PARIS will not refund any price difference between the time the order was placed and a subsequent price reduction<\/p>\n

2. Terms of payment<\/p>\n

The products are payable cash the day of the effective order.<\/p>\n

The payment of the purchases is carried out either by bank card.<\/p>\n

The Customer accesses a dedicated space provided by a banking institution, which ensures the security and registration of the payment order. The Customer confirms that he is the holder of the bank card to be debited and that the name on the bank card is indeed his. The Customer communicates the sixteen digits and the expiry date of his bank card, as well as, if necessary, the numbers of the visual cryptogram. In this regard, the Customer expressly acknowledges that providing their credit card number to FRAN\u00c7OISE PARIS constitutes authorization to debit their account for the amount of the products ordered, including all taxes. In accordance with Article L. 132-2 of the French Monetary and Financial Code, the commitment to pay by means of a payment card is irrevocable. FRAN\u00c7OISE PARIS implements all means necessary to ensure the confidentiality and security of data transmitted on the Website.<\/p>\n

3. The data recorded and stored by RFRAN\u00c7OISE PARIS constitutes proof of the order and all transactions made. The data recorded by the payment system constitutes proof of the financial transactions.<\/p>\n

4. As part of its order verification policy and in order to limit the risk of identity theft and\/or the use of stolen payment methods, FRAN\u00c7OISE PARIS reserves the right to ask the Customer for a copy of their ID and proof of address. In this case, the order will be definitively validated after verification of these elements.<\/p>\n

FRAN\u00c7OISE PARIS reserves the right to refuse any order that is declined by the banking institutions.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab gutter_size=”2″ column_padding=”2″ title=”V – DELIVERY” tab_id=”1652264759107-4-9″][vc_column_text uncode_shortcode_id=”647444″]The Customer chooses one of the delivery methods offered on the Site when placing the order. The ordered products are delivered according to the mode of transport available according to the place of delivery.<\/p>\n

Delivery is made to the delivery address indicated by the Customer at the time of his order, it being specified that this address must be the residence address of the Customer or of any other natural person of his choice domiciled in metropolitan France or in the following countries: Germany, United States, Canada, Japan, Singapore, South Korea, Great Britain, Ireland, Switzerland, Belgium, Spain. Delivery cannot be made to hotels or post office boxes.<\/p>\n

The amount of the delivery charges depends on the amount of the order and the delivery method chosen by the Customer. The amount of the delivery costs is indicated to the Customer before the validation of the order.<\/p>\n

Delivery times are available on the Site in accordance with the conditions set forth in Article L. 111-1-3\u00b0 of the French Consumer Code.<\/p>\n

In order for delivery times to be met, the Customer must ensure that they have provided FRAN\u00c7OISE PARIS with accurate and complete information regarding the delivery address (including, but not limited to: street number, building number, staircase number, access codes, names and\/or intercom numbers, special delivery instructions, etc.) before confirming their order.<\/p>\n

The times indicated are indicative times, corresponding to the average processing and delivery times. FRAN\u00c7OISE PARIS cannot be held liable for the consequences of any delay in delivery that is not attributable to it.<\/p>\n

In case of delay in delivery, the order is not automatically cancelled. FRAN\u00c7OISE PARIS will inform the Customer of any delay, and the Customer may then decide to cancel the order and send a notice of cancellation by registered letter with acknowledgment of receipt to the following address:<\/p>\n

If the order has not yet been shipped when FRAN\u00c7OISE PARIS receives the Customer’s cancellation notice, delivery will be blocked and the Customer will be refunded any amounts debited as soon as possible after receipt of the cancellation notice.<\/p>\n

If the order has already been shipped when FRAN\u00c7OISE PARIS receives the Customer’s cancellation notice, the Customer may still cancel the order by refusing the package. FRAN\u00c7OISE PARIS will then refund the amounts debited and the return costs incurred by the Customer within fifteen (15) days of receiving the returned package, which must be complete and in its original condition. <\/p>\n

The Customer is required to check the condition of the packaging and the products upon delivery. In the event of a damaged package (already opened, missing products, etc.), the Customer undertakes to notify the carrier and FRAN\u00c7OISE PARIS of all their reservations within three (3) days of receiving the product by registered letter with acknowledgment of receipt.<\/p>\n

Failure to file a claim within the aforementioned time period shall extinguish any action against the carrier in accordance with Article L. 133-3 of the Commercial Code.[\/vc_column_text][\/vc_accordion_tab][vc_accordion_tab gutter_size=”2″ column_padding=”2″ title=”VI – WITHDRAWAL RIGHTS” tab_id=”1652264795192-5-1″][vc_column_text uncode_shortcode_id=”185891″]VI -A. In accordance with article L. 221-18 of the French Consumer Code, the individual customer has the right to withdraw from the contract within fourteen (14) clear days of delivery of the order, without giving any reason, in order to return one or more products ordered and be reimbursed without having to give any reason or pay any penalty.<\/p>\n

Where this period expires on a Saturday, Sunday or public holiday, it shall be extended to the next working day. In the case of an order for several products delivered separately, the period runs from the receipt of the last product which will be exercised by returning at its expense the new products (in their original packaging, not worn, not washed) accompanied by the order number to the following address<\/p>\n

VI-B. The consumer Customer informs FRAN\u00c7OISE PARIS of their decision to withdraw by sending them, before the expiry of the period stipulated in Article VI-A in the previous paragraph, the withdrawal form mentioned in Appendix 1 or any other unambiguous statement expressing their wish to withdraw.<\/p>\n

VI-B. The Customer must return the products subject to the right of withdrawal no later than fourteen (14) days following the communication of his decision to withdraw. The return of new products (in their original packaging, not worn, not washed), accompanied by the number of orders, will be at the expense of the Customer and to the following address<\/p>\n

VI-C. The right of withdrawal may be excluded in the case of orders for personalized products or products made to the customer’s specifications.<\/p>\n

VI-D. If FRAN\u00c7OISE PARIS considers several returns to be abusive or abnormal, FRAN\u00c7OISE PARIS reserves the right to refuse future orders from the Customer concerned. The Customer’s liability may be incurred in the event of depreciation of the Products resulting from handling other than that necessary to establish the nature and characteristics of the Products.<\/p>\n

FRAN\u00c7OISE PARIS will reimburse the Customer for any sums already paid (including shipping costs), excluding return shipping costs, under the conditions set out in Article VII below, within 14 days of the date on which the goods are recovered. The refund will be made by the same method of payment chosen by the Customer at the time of his order, unless the Customer agrees to use another method of payment that does not incur costs.<\/p>\n

FRAN\u00c7OISE PARIS shall not be required to reimburse additional costs if the Customer has expressly chosen a more expensive delivery method than the standard delivery method with signature.<\/p>\n

Refunds for products in the cases referred to in Article II shall be made by FRAN\u00c7OISE PARIS within a maximum period of 30 days after receipt of said products. The refund will be made by the same method of payment chosen by the Customer at the time of his order.<\/p>\n

FRAN\u00c7OISE PARIS guarantees the Customer effective recourse to a consumer mediation system in accordance with the provisions of Articles L. 611-1 et seq. of the French Consumer Code. The Customer may refer the matter to the mediator of his choice, whose contact details can be found on the European Commission’s website:<\/p>\n

In accordance with the provisions of Law No. 78-17 of January 6, 1978 known as “Informatique et Libert\u00e9s”, the Customer has the right to access, rectify, modify and delete personal data concerning him\/her at any time if they are inaccurate, incomplete, ambiguous or outdated.<\/p>\n

The Customer also has the right to object, for legitimate reasons, to the processing of personal data concerning him. However, such opposition will make it impossible to execute the order.<\/p>\n
